Terms of Service

These terms apply to the Mimi app and the mimi-app.com.br website, provided by XISTO EMPREENDIMENTOS DIGITAIS LTDA - ME (CNPJ 65.338.562/0001-95), a company registered in Brazil (“we”). By creating an account or using Mimi, you agree to them and to our Privacy Policy.

1. What Mimi is

Mimi helps dog owners look after their dogs’ food and routine: it tells you whether a food is safe to offer, keeps a diary of meals, water, stool and weight, shows progress and gives tips.

Mimi doesn’t replace your vet. The information is educational; it isn’t a diagnosis, a prescription or a diet plan, and it may not apply to your dog. In an emergency, such as eating something toxic, blood in the stool, persistent vomiting or lethargy, see a vet right away.

2. Your account

• You sign in without a password, with a code sent to your email, or with your Apple or Google account. Keep access to your email safe: anyone who can read it can sign in to your account.
• You must be 18 or older, or use Mimi with the permission of a parent or legal guardian.
• Keep your account and your dog’s details accurate: Mimi’s answers depend on them.

3. Free plan and Mimi Premium

• The free plan has limits, which the app shows when you reach them.
• Mimi Premium is a monthly or yearly subscription, bought through the App Store and charged by Apple to your Apple Account. The price is shown in the app before you buy.
• If the offer includes a free trial, billing starts when it ends, unless you cancel before then.
• The subscription renews automatically unless you cancel it at least 24 hours before the end of the period. You manage and cancel it in your iPhone’s Settings, under Apple ID → Subscriptions.
• Deleting your Mimi account doesn’t cancel the subscription: cancel it in the App Store too, so you aren’t charged again.
• Refund requests go to Apple, at reportaproblem.apple.com, under Apple’s rules and your consumer rights.

4. Your data and your content

What you record in Mimi (your dog’s profile, the diary, photos and notes) stays yours. You allow us to store and process it only to provide the service, as the Privacy Policy explains. You can export your data and delete your account at any time in the app’s Settings. Food suggestions you send us may be used to improve the content, with no link to you.

5. Acceptable use

When using Mimi, you may not:

• use the service for illegal purposes, or upload illegal content or someone else’s content without permission;
• try to access someone else’s account or parts of the service that aren’t yours;
• overload or disrupt the service;
• copy the content in bulk by automated means, or reverse engineer the app, except where the law allows it.

6. Mimi’s content and brand

The app, the name, the mark and the content (such as the food guides and the tips) are ours or used with permission. We prepare the content carefully, from reference sources, and update it as needed, but it may contain mistakes or become outdated.

7. Availability and changes to the service

We work to keep Mimi running, but it may be unavailable for maintenance, failures or reasons beyond our control. We may change, add or remove features; if a change affects what you pay for, we’ll tell you first.

8. Liability

To the extent the law allows, we aren’t liable for decisions about your dog’s health made without a vet’s guidance, or for failures caused by third parties, such as your connection or your device. Nothing in these terms limits your rights under Brazil’s Consumer Protection Code.

9. Termination

You can stop using Mimi and delete your account whenever you want. We may suspend or close accounts that break these terms, with notice whenever possible.

10. App Store

If you downloaded Mimi from the App Store, your use of the app is also governed by Apple’s standard end user license agreement. Apple isn’t a party to these terms and isn’t responsible for Mimi or its support.

11. Changes to these terms

If we change these terms, we’ll update the date at the top and, for important changes, let you know in the app before they take effect.

12. Governing law and venue

These terms are governed by the laws of Brazil. Disputes go to the courts where you live.
